Advantageous financing for your business

  • a) The applicant is a micro, small or medium-sized enterprise, as defined in Art. 4 of Law no. 179/2016 on small and medium-sized enterprises;
  • b) The applicant does not conduct activities or the intended use of the credit funds does not relate to ineligible activities listed in the Guarantee Agreement or the Guarantee Scheme;
  • c) The beneficiary has repayment capacity and is considered viable for lending in accordance with the Creditor’s internal policies;
  • d) The beneficial owner of the Applicant is identified;
  • e) The applicant has not registered overdue loan payments exceeding thirty (30) consecutive days in the last year and exceeding ninety (90) consecutive days in the last three years;
  • f) The applicant confirms the absence of any outstanding payments to the state budget;
  • g) The applicant does not carry out illegal activities within its business;
  • h) The applicant, including beneficial owners and shareholders, is not included in any financial sanctions lists observed by the Creditor in accordance with the internal anti–money laundering and counter-terrorist financing policy;

A. The following activities will not be supported under the Guarantee Scheme:

  1. activities that may cause significant impacts requiring a full Environmental Impact Assessment (EIA), according to national Law no. 86/2014;
  2. any investments related to timber harvesting and/or that may impact forest health;
  3. production and processing of Genetically Modified Organisms (GMOs);
  4. activities located in protected areas, critical habitats, or culturally or socially sensitive areas recognized under national regulations (Ref.: ESS6 – Biodiversity Conservation; ESS8 – Cultural Heritage);
  5. activities that may cause permanent or temporary physical or economic displacement of landowners or users (Ref.: ESS5);
  6. activities involving forced labor or child labor, reported or significant concern regarding sexual exploitation and abuse or sexual harassment (Ref.: ESS2);
  7. purchase of pesticides classified as “I, II or III of the RM Toxicity Group”, “Ia, Ib or II of the WHO Toxicity Class” and/or “banned or severely restricted by the EU” (Ref.: ESS3);
  8. large-scale irrigation systems and subprojects involving discharge of wastewater directly into international waterways (Ref.: OP/BP 7.50).

B. The Guarantee Scheme will also not support other types of subprojects specified in the IFC/WB Exclusion List:

  1. Production or trade in products deemed illegal under host country laws or international conventions.
  2. Production or trade in weapons and ammunition.*
  3. Production or trade in alcoholic beverages (excluding beer and wine).*
  4. Production or trade in tobacco.*
  5. Gambling, casinos, and equivalent enterprises.*
  6. Production or trade in radioactive materials (except medical equipment).
  7. Production or trade in non-bonded asbestos fibers.
  8. Drift net fishing exceeding 2.5 km.
  9. Forced labor / harmful child labor.
  10. Production or trade in timber from unsustainably managed forests.
  11. Hazardous chemicals in significant volumes.
  12. Activities affecting indigenous peoples’ lands without consent.

C. In accordance with Article 12 of Law no. 179/2016, the following companies are not eligible for support:

  1. companies holding a dominant market position;
  2. companies with non-SME founder share > 25%;
  3. companies importing excisable goods;
  4. trust companies and insurance companies;
  5. collective investment undertakings;
  6. banks;
  7. non-bank credit organizations and savings and loan associations;
  8. pawnshops and currency exchange units;
  9. gambling enterprises;
  10. voluntary pension funds;
  11. companies with repeated legal violations.
